HoyleCohen, LLC collects information from you in accordance with industry standards and regulatory requirements. Such information includes your name, how you want your account established, your address, social security number, drivers license number, telephone number, employer information, tax bracket, annual income, net worth, liquid assets, investment history, investment objectives, risk preferences, number of dependents, marital status, and whether you or your immediate family members are affiliated with or employed within the financial services or banking industries. This information is required in order for us to service your account.
We obtain this information from you on the paper application you complete when you first open an account with HoyleCohen, LLC, and in personal conversations with you. We transfer much of the information, which we gather from your paper application, into a computer database. The information we gather is available to all HoyleCohen, LLC departments and employees. It may also be necessary, from time to time, to share this information with certain unaffiliated third parties with whom we must interact in order to conduct business on your behalf. These third parties may include our clearing broker/dealers, the custodians of the assets held in your account(s), mutual fund companies, and portfolio managers.
We do not provide or disclose any nonpublic information to unaffiliated third parties for marketing purposes or any other reason whatsoever, except to the extent that may be necessary for us to conduct business on your behalf. HoyleCohen, LLC does not sell or share lists of active or inactive customers.
"Opt-Out" Right The new laws require that we give you the means to prevent the transfer of your nonpublic, personal information to a non-affiliated third party before the information is disclosed.
Your right to “opt out” of our disclosure of your nonpublic, personal information does not apply where such information must be shared to produce a consolidated statement, to complete a transaction, or to service your account. Your right to “opt out” also does not apply to information we are required to share with Focus Financial Partners, LLC due to regulatory requirements.
Please contact us at (858)576-7300 to express your desire to “opt-out” of our disclosure of your nonpublic, personal information (with the exceptions noted above).
Security and Confidentiality Safeguards At HoyleCohen, LLC, we have established measures to ensure the security and confidentiality of customer information. Our computer database has software firewalls installed to protect against threats or hazards to the security and/or integrity of customer records. We fingerprint all newly hired employees who have access to client information. HoyleCohen may, on occasion and without prior notice, record telephone conversations for quality control and compliance monitoring purposes.
If you discontinue using HoyleCohen’s services, we retire your account information. Your account is considered closed once your last account position has been transferred from our system and our discretionary access has been removed. From that closure date, we maintain your records for at least three (3) years (but generally no more than six (6) years). However, as long as any Investment Advisor Representative of HoyleCohen, LLC remains listed on your account(s) as the representative of record, we consider your account to be active, even if you have otherwise terminated your relationship with us.
At HoyleCohen, LLC we understand the trust and confidence placed in us by our clients. And we will continue to use discretion and respect in regard to our client's personal privacy.
